Philip Durack brings to his cases some 26 years of commercial law experience.

He gained his early experience as a solicitor commencing with 3 years in London (Freshfields) followed by eighteen months in Hong Kong (Baker & McKenzie) and then 3 years in Sydney (Allens Arthur Robinson).

He has been a member of 11 Wentworth/Selborne Chambers since 1992. He is also an interstate member of Francis Burt Chambers in Perth.

This experience has exposed him to a wide range of business activities and to diverse issues arising from financial distress, regulatory intervention, fraud, non-compliance with directors duties and trade practices standards, contractual default and negligence.

He has acted in some of the nation's most complex pieces of litigation.




Some of his recent matters include:

  • PTTC v ITSL & ERG, acting for the Public Transport Ticketing Corporation in its claim against ERG (and defence of a counterclaim for some $200m) arising out of the termination of the TCard contract for the supply of a smartcard ticketing system for Sydney;
  • Proceedings under the Corporations Act, including acting for ASIC in the three year civil penalty trial of Rich and Silbermann (ASIC v Rich), former directors of One.Tel, arising out of the collapse of One.Tel in 2001 and in the civil penalty trial of Rodney Adler, Ray Williams and Dominic Fodera (ASIC v Adler), the former directors of HIH, and the subsequent appeal, and acting for a broker facing banning by ASIC for allegedly spreading false rumours about Macquarie Bank;
  • Various contractual and trade practices disputes, including acting for Defendants in Brown v Hodgkinson [2009] NSWSC 262, a claim for specific performance in relation to a buy-out of interests in various large scale property developments in Sydney, and acting for a Sydney hospital in a dispute over rights to operating theatres.
